Under Maryland Code, Transportation 21-901.1(b), negligent driving is defined as operating a motor vehicle in a careless or imprudent manner that endangers either property or the safety of any individual. The Judge must find the accused driver did not exercise the same amount of care that a "driver of ordinary care" would have demonstrated "under similar circumstances."

On other occasions, a Maryland State Trooper or county police officer will charge a motorist with negligent driving just because s/he had the misfortune of being involved in an accident. Although State's Attorneys and District Court judges are sometimes persuaded to offer Probations Before Judgment (PBJ's), the maximum fine for negligent driving is a $140 fine plus one point against your driver's license.
