Joint Legal Custody in Baltimore County.

Legal custody refers to the right and obligation to make long-range decisions concerning long-range decisions including education, religious training, discipline, medical care and other matters of major significance. Before a court order is entered, each parent has equal legal custody rights. When joint legal custody is agreed upon or court-ordered, the parents are required to make all important Long-term decisions together and in the event of a deadlock only the Court has the final say, unless there is a provision concerning tie-breaker authority.

Dispute Resolution Under Joint Legal Custody

Tie-Breaker authority allows one parent to resolve deadlocks concerning Long-range decisions even though it is still joint legal custody. Just like simple joint legal custody, both parents are expected to share important documents, communicate with one another about important decisions and try to reach a meeting of the minds. If the process ultimately fails, however, the parent with tie-breaker authority makes the decision without filing motions to being the dispute to the attention of the Court.

Another way to approach disputes between joint legal custodians is to require they enter mediation in the event of a deadlock. When formulating the joint custody provision, the parties may select a private mediator or agree to use The Baltimore County Office of Family Mediation located on the fifth floor in Room 505. if frequent disputes are expected to persist between the parties, then a parent coordinator should be strongly considered. on the other hand, neither mediators nor parent coordinates may be vested with the power to resolve a legal custody deadlocks.

Is Joint Legal Custody Appropriate For Your Baltimore County Family?

There is a strong trend in child custody litigation in Circuit Court for Baltimore County and the Circuit Court for Harford County in favor of awarding joint legal custody unless there are multiple red flags. The individual judge has a judicial discretion to determine whether an award of joint legal custody is appropriate. For this reason, opposing joint legal custody requires planning, strategy, and the presentation of convincing evidence to the court

The strongest indication in child custody matters that joint legal custody is appropriate is when both parents have a strong track record of communicating and working together including during the period of separation to reach a reasonable settlement.
