Biological Parents Have Joint Natural Custody Until There Is a Court Order.
If there is no court enter governing legal custody and physical custody, then the parties have joint natural guardianship pursuant to MD Code, Family Law ¶5-203, which states that both parents are the natural guardians of the minor children. That guardianship passes to only one parent to the extent that the other parent dies, abandons the family, or is incapable of acting as a parent. Both parents are jointly and severally liable to support the child monetarily. However, these duties can shift to a grandparent if one or both children are minor children who have not been emancipated. The joint natural guardianship terminates to the extent that:
- Both parents live separate and apart;
- The Circuit Court enters and order concerning cutody of the minor child.
