Baltimore County Family Lawyer Discusses New Maryland Family Laws

The Law Offices of Amar S. Weisman monitors developments in family law through each session of the General Assembly and takes note of changes and developments to the Maryland Family Law Article. During the 2015 and 2016 legislative sessions, there have been efforts to make the judicial process easier for people going through divorce and child custody cases. There are two laws going into effect on October 1, 2016 that caught our attention.

New Courts & Civil Proceedings Laws

The first is Children in Need of Assistance, Guardianship, Adoption, Custody, and Visitation — Blindness of Parent/Guardian (SB 765). This says that in cases where the parents are disabled, disabilities (including blindness) cannot discredit the parent, unless it is proven that the disability is not in the best interest of the child.

The implementation of this law could make a huge difference for families in which the parents are disabled. Now, parents with disabilities will still be allowed to care for their children, so long as the children are not negatively impacted by the parent’s condition.

The second is Divorce-Corroboration of Testimony (SB 359, HB 274). This reverses previous laws by allowing courts to enter decrees of divorce on behalf of one spouse without the agreement of another. Additionally, it establishes that a separation agreement is no longer sufficient to show that both spouses want an absolute divorce.

Previously, a third party was required to corroborate the grounds of divorce, which meant that a witness was required to testify that both spouses had lived separately during the separation period. With this requirement wiped away, uncontested divorce may be easier for couples to obtain.
