When Child Custody comes before the Circuit Court For Baltimore County, the court determines two different types of Custody, Legal Custody and Physical Custody. The court does not necessarily award Legal Custody and Physical Custody to the same parents. Legal Custody refers to the power to make important long-term decisions, such as:
- The right to make long-term educational decisions including choosing schools, extracurricular activities, IEP programs and sports.
- The right to make long-term health care decisions including vaccinations, selecting the pediatrician and mental health counselors.
- The right to make religious decisions including religious affiliation, baptisms and Sunday school enrollment.
- The right to make disciplinary decisions including resolving questions of corporal punishment.
Joint Legal Custody in The Circuit Court for Baltimore County.
Joint legal custody gives both parents the authority to participate equally in significant long term decisions affecting the minor child's health, education, and welfare.
Whenever joint legal custody is awarded by The The Circuit Court for Baltimore County or The CIrcuit Court for Harford County, the two parents must make major decisions together. To avoid a deadlock, one parent may be granted tie breaker authority. If the court finds it is not in the child's best interest for the parents to make decisions together, the court may award sole legal custody to one parent.
When considering the question of legal custody, it is almost certain that the Towson court will examine the written communications between the parties including email and text message communications. Where the parties have a strong communications track record, an award of joint legal custody is probable.
