Biological Parents Have Joint Natural Custody Until There Is a Court Order.
If no court has entered an order governing legal and physical custody, then the parties have joint natural guardianship under MD Code, Family Law ¶5-203, which states that both parents are the natural guardians of the minor children. That guardianship passes to only one parent to the extent that the other parent dies, abandons the family, or is incapable of acting as a parent. Both parents are jointly and severally liable to support the child monetarily. However, these duties can shift to a grandparent if one or both children are minor children are not emancipated. The joint natural guardianship terminates to the extent that:
- Both parents live separate and apart;
- The Circuit Court enters a custody order
